MegsyAnn (“we”, “our”, “us”) is committed to providing quality services to you, and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

What Is Personal Information and Why Do We Collect It?

This Personal Information is obtained in many ways, including through correspondence, by telephone, by email, via our website www.megsyann.com, through enquiry and application forms, at checkout when you purchase from us, through scheduling and booking tools, via messaging platforms used to deliver our services, through our social media accounts, from publicly available sources, from cookies, and from third parties. We do not guarantee the websites, links or policies of third parties.

We collect your Personal Information for the primary purpose of providing our services to you, communicating with you, processing payments, providing information to our clients, and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

  • For a secondary purpose that is directly related to the primary purpose;
  • With your consent, or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such cases we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances, including:

  • To third party service providers we use to operate our business, including payment processors, email marketing platforms, scheduling and booking tools, community and messaging platforms, website hosting, cloud storage and analytics providers, strictly for the purpose of providing our services;

Disclosure Overseas

Some of the third party service providers we use store or process data outside Australia, including in the United States and other jurisdictions where their servers are located. By providing your Personal Information to us, you consent to its disclosure to these overseas recipients for the purposes described in this policy. We take reasonable steps to use reputable providers who handle Personal Information in a manner consistent with the Australian Privacy Principles, however overseas recipients may not be subject to the Privacy Act and you may not have the same remedies available against them under Australian law.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify it. However, most Personal Information is or will be stored in client files which will be kept by us for a minimum of seven years to meet our legal and accounting obligations.

In the event of a data breach involving your Personal Information that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act, including notifying you and the OAIC where required.

Cookies and Analytics

Our website uses cookies and analytics tools to help us understand how visitors use the site and to improve our services and marketing. Cookies do not personally identify you, although they may identify your device and browsing behaviour. You can configure your browser to refuse cookies, however some parts of the website may not function fully if you do.

Direct Marketing

We will not charge a fee for your access request, but may charge a reasonable administrative fee for providing a copy of your Personal Information. We will respond to access and correction requests within a reasonable period, and in any case within 30 days.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of Your Personal Information

It is important to us that your Personal Information is up to date. We will take reasonable steps to ensure your Personal Information is accurate, complete and current. If you find that the information we hold is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and continue to provide quality services to you.
